German doctors should question extra hospital shifts

Extra shifts are voluntary only outside your agreed duties. Repeated last-minute cover and missing rest time show unsafe hospital staffing.

Extra hospital shifts are voluntary only when your contract and rota do not require them. If the same empty night shifts appear every week, the hospital has a staffing problem. It is using junior doctors to cover it.

Start with your contract

Read the section on working hours, night duty, weekend duty, and on-call duty. Your employment contract says which duties belong to your junior doctor job (Assistenzarzt).

A named duty in your rota is part of your job. You cannot call it voluntary just because the rota came late. The chief or rota manager must still follow working-time rules.

An extra shift is different. It is a shift outside your agreed rota. The ward asks you to take it because another doctor is ill, away, or missing.

When is an extra shift voluntary

It is voluntary when you can say no without losing your normal rota days. Ask for the shift in writing. Ask how it will be paid or balanced with time off.

  • Your original rota has no duty that day.
  • The ward asks you by phone, email, or message.
  • You choose whether to take the shift.
  • The rota manager confirms pay or time off in writing.

Three staffing warning signs

One extra weekend during an influenza wave is normal. The warning starts when empty lines stay on every monthly rota. Then the hospital has too few doctors for its beds.

The same people cover every gap

Look at 2 or 3 old rotas. If the same junior doctors work extra nights repeatedly, the department is relying on goodwill instead of hiring doctors.

The rota arrives at the last minute

A safe department publishes a rota early enough for childcare, travel, and sleep. A department that changes duties through WhatsApp every Friday is passing its staffing failure to the ward.

Your rest time disappears

German law normally requires 11 hours of rest after work. Hospitals can reduce this by 1 hour in limited cases, but they must give the lost hour back later.

The normal workday is 8 hours. It can reach 10 hours if the average returns to 8 hours over the legal reference period. Collective agreements can contain special rules for hospital on-call duty.

What to say before agreeing

Do not argue alone in the corridor at 7pm. Send one calm message to the rota manager. Keep the rota, messages, and your worked hours in one folder.

Write: “Is this shift part of my contractual rota or an extra voluntary shift? Please confirm payment or time off, and my rest period afterwards.”

What to do now

  • Read your contract section on night and weekend duty.
  • Save 3 monthly rotas as PDFs or screenshots.
  • List each extra shift, its date, and your rest hours.
  • Ask the rota manager in writing whether the next shift is contractual or voluntary.
  • Speak to your staff council if repeated gaps remove your rest time.
